1. Acceptance of Terms
These Terms of Use (“Terms”) govern your access to and use of the Limo Lux website, online booking platform, and related services (collectively, the “Services”), operated by Limo Lux (“Limo Lux,” “we,” “us,” or “our”), based in Boston, Massachusetts.
By accessing our website, booking a reservation, or otherwise using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Services.
2. Description of Services
Limo Lux provides black car and chauffeur transportation services, including but not limited to airport transfers, hourly and daily chauffeur service, point-to-point transportation, corporate travel, sporting event transportation, and special occasion transportation, throughout Boston, Massachusetts, and the surrounding New England region.
3. Reservations and Bookings
3.1 Booking Accuracy
When making a reservation, you agree to provide accurate, current, and complete information, including pickup and drop-off locations, date and time, passenger count, flight information (where applicable), and contact details. Limo Lux is not responsible for delays or service issues resulting from inaccurate or incomplete information provided at booking.
3.2 Confirmation
A reservation is not guaranteed until you receive confirmation from Limo Lux, whether by email, text, or other communication. We reserve the right to decline or cancel a reservation at our discretion, including in cases of suspected fraud, abuse, or unavailability of vehicles or chauffeurs.
3.3 Vehicle Assignment
While we make reasonable efforts to honor requested vehicle classes, Limo Lux reserves the right to substitute a comparable or upgraded vehicle due to availability, mechanical issues, or operational necessity.
4. Pricing and Payment
4.1 Rates
Rates are quoted at the time of booking and are based on the information provided, including vehicle class, trip type, distance, and duration. Quoted rates are subject to change if trip details change after booking (such as additional stops, extended wait time, or a change in destination).
4.2 Minimum Fares
A minimum fare may apply to certain trip types and vehicle classes, as reflected in the quoted rate at the time of booking.
4.3 Payment
Payment is processed through the payment method provided at booking or through a corporate account with approved billing arrangements. You are responsible for ensuring that payment information provided is accurate and valid.
4.4 Gratuity
Gratuity is not automatically included in quoted rates unless otherwise stated and is left entirely to your discretion.
5. Cancellation Policy
Cancellations made more than 24 hours before the scheduled pickup time are eligible for a full refund. Cancellations made within 24 hours of the scheduled pickup time may be subject to a cancellation fee. Specific cancellation terms may vary by trip type, vehicle class, or season (including peak demand periods such as holidays), and will be communicated at the time of booking where applicable. 6. Wait Time and Delays
6.1 Airport Transfers
Limo Lux monitors flight status for airport transfers and adjusts chauffeur arrival accordingly. Complimentary wait time is included for airport pickups to account for delayed or early flights, as described at the time of booking.
6.2 Non-Airport Trips
For non-airport pickups, a grace period applies as communicated at booking. Excessive delays beyond the applicable grace period may result in additional charges or, in cases of no-show by the passenger, forfeiture of the trip fare.
6.3 Limo Lux Delays
While we make every reasonable effort to ensure punctual service, Limo Lux is not liable for delays caused by circumstances beyond our reasonable control, including but not limited to traffic, weather, road closures, mechanical failure, or other events of force majeure as described in Section 12.
7. Passenger Conduct
You agree to:
- Treat chauffeurs and Limo Lux staff with respect and courtesy
- Not engage in illegal, abusive, threatening, or disorderly conduct during a trip
- Not smoke, vape, or consume illegal substances in any Limo Lux vehicle
- Be responsible for any damage caused to a vehicle by you or your guests during a trip, including cleaning fees for excessive mess or damage
Limo Lux reserves the right to terminate a trip without refund if a passenger’s conduct is deemed unsafe, abusive, or in violation of these Terms, including the right of any chauffeur to refuse service or end a trip early under such circumstances.
8. Liability and Disclaimers
8.1 Service “As Is”
Our Services are provided on an “as is” and “as available” basis. While we strive to provide reliable, professional transportation, we do not guarantee that the Services will be uninterrupted, error-free, or available at all times.
8.2 Limitation of Liability
To the fullest extent permitted by law, Limo Lux, its officers, employees, and chauffeurs shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our Services, including but not limited to missed flights, missed events, or other losses resulting from delays, except where such liability cannot be excluded under applicable law.
8.3 Personal Property
Limo Lux is not responsible for personal belongings left in a vehicle. We will make reasonable efforts to return lost items if reported promptly, but cannot guarantee recovery.
9. Insurance
Limo Lux vehicles and chauffeurs operate under applicable commercial insurance coverage as required by Massachusetts and federal transportation regulations. This insurance covers incidents arising from the operation of the vehicle in accordance with applicable law and does not extend to unrelated personal claims.
10. Intellectual Property
All content on the Limo Lux website, including text, graphics, logos, images, and software, is the property of Limo Lux or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from this content without our prior written consent.
11. Third-Party Links and Services
Our website may contain links to third-party websites or integrate third-party booking and payment tools. Limo Lux is not responsible for the content, privacy practices, or terms of use of any third-party websites or services.
12. Force Majeure
Limo Lux shall not be held liable for any failure or delay in performance resulting from causes beyond our reasonable control, including but not limited to acts of God, severe weather, natural disasters, government action, road closures, strikes, pandemics, or other events of force majeure.
13. Modifications to Terms
Limo Lux reserves the right to modify these Terms at any time. Changes will be effective upon posting to our website. Your continued use of our Services after changes are posted constitutes acceptance of the revised Terms. We encourage you to review these Terms periodically.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, without regard to its conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Massachusetts.
15. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
